Proposed Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 4809, 2014, and proposed Phased Development Agreement Authorization Bylaw No. 4821, 2014 (regarding proposed subdivision of 6447 and 6475 Pitt Street into three smaller lots) (File: 1610-20-4809 / 1610-20-4821 / 1010-20-14-011)
The Director of Planning, Land Development and Permits will describe the subject application.
Applicant: J. L. Murray
Subject Lands: 6447 and 6475 Pitt Street (Amended Lots 19 and 21 (Explanatory Plan 6596) Block 49 District Lot 430 Plan 4103)
Purpose: Proposed subdivision of 6447 and 6475 Pitt Street into three smaller lots: the proposed bylaws would facilitate the subdivision of the subject lands on Pitt Street by amending the Zoning Bylaw to allow alternative site area and site width and authorize a Phased Development Agreement to secure community benefits. The proposed Development Variance Permit would allow for retention of an existing dwelling with a variance to the minimum combined side yard. When originally subdivided (subdivision plan deposited with the Land Title Office in 1909) the subject lands were configured as three 50-foot wide lots. The configuration existed until the subject lands were consolidated and re-subdivided into two 75-foot wide lots (approved under Land Registry Act in 1961). This application would return the existing two lots to the original three lot configuration, consistent with the majority of residential lots currently in the neighbourhood.
Proposed Zoning Bylaw Amendment: If adopted, proposed Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 4809, 2014 would amend the RS4 zone by allowing alternative site area and site width for the subject lands as described in this notice.
Proposed Phased Development Agreement Authorization Bylaw: If adopted, proposed Phased Development Agreement Authorization Bylaw No. 4821, 2014 would authorize the District and the landowners to enter into a Phased Development Agreement under the Local Government Act that would:
• secure a Community Amenity Contribution of $98,250; and
• have a term of five years, during which time changes to the Specified Zoning Bylaw Provisions (being all of those provisions of the Zoning Amendment Bylaw that regulate minimum site area and site width for the purpose of subdivision and are applicable to the subject lands) would not apply to the development without the developer’s consent.
Proposed Variance Development Permit: If approved, proposed Development Variance Permit No. 14-011 would allow for the existing dwelling at 6475 Pitt Street to be retained with a variance to the Zoning Bylaw to allow for a minimum combined side yard of 4.10 metres where 4.57 metres is normally required. The variance is proposed to apply only to the existing dwelling, and any future replacement dwelling would be required to comply with the Zoning Bylaw.

Mayor Smith will describe the procedure for the public hearing as follows:
We are convening this public hearing to consider and receive submissions regarding proposed Zoning Bylaw No. 4662, 2010, Amendment Bylaw No. 4809, 2014, and proposed Phased Development Agreement Authorization Bylaw No. 4821, 2014 (regarding proposed subdivision of 6447 and 6475 Pitt Street into three smaller lots).
A public meeting will be held concurrently with the public hearing to receive submissions regarding proposed Development Variance Permit No. 14-011 (6475 Pitt Street). Anyone who believes their interest in property is affected by the proposed bylaws and/or the proposed development variance permit will be heard, and/or may make a written submission. No one will be discouraged or prevented from making his or her views heard.
Council members may ask questions of you following your presentation but our function tonight is to listen to the views of the public, not to debate the proposed bylaws and proposed development variance permit.
After the public hearing and concurrent public meeting has concluded, Council may, without further notice, give whatever effect Council believes proper to the representations.
Your only opportunity to comment on the proposed bylaws is during the public hearing. Council is not permitted to receive further submissions once we have closed the public hearing.
Council has received documents which are available for your review. A list of documents and copies of these may be obtained from the Municipal Clerk during the public hearing and concurrent public meeting. Written submissions received during the course of these proceedings will be added to these documents so that everyone may examine them.
To maintain order and to ensure that everyone has an opportunity to be heard here are our rules of procedure:
1. A Speakers’ List has been established. You may place your name on the list at any time throughout the public hearing and concurrent public meeting. If you are speaking from prepared remarks, we would appreciate a copy.
2. We request that you please begin your remarks by stating your name and address. If you are speaking on behalf of some other person or organization, we request that you please identify the name of that person or organization.
3. Please limit your remarks to 5 minutes (a bell will sound with 15 seconds to go) and to the subject of the proposed bylaws and proposed development variance permit. Please be respectful to others.
4. After everyone has spoken once, you will have an opportunity to speak subsequent times to provide additional information, if you wish.
